Patent Filing Services – Scope Of Services

Patent Application Process

We take our clients through every stage in a step-by-step process, from an initial disclosure to drawing creation, to a first application, to a first grant, and to maintaining an extensive portfolio in multiple countries.

In determining whether a client should file a patent application, we are able to advise inventors and entrepreneurs alike, regardless of whether they are novice or expert in terms of experience.

Our initial consultation typically involves meeting and discussing with a client any particular invention or innovation for which they may be interested in seeking protection.

During that meeting we’ll try to discuss in detail not just the client’s invention but the key principles behind the invention.

During that meeting clients will be encouraged to present their best information regardless of whether they have drawings on napkins or full-blown multimedia presentations – we can handle any disclosure format.

If a client determines they want to proceed with us preparing an application, we’ll discuss clearance search options.

Clearance searches are not mandatory in Canada, and do not impact an Examiner’s search per se, but clearance type searches provide valuable information in the preparation of patent applications.

Although clearance searches tend to add to the price of preparing an application in Canada, those clearance searches provide valuable information and insight into what may be expected during the application prosecution phase.

If a clearance search appears favorable, we’ll take the time and care to prepare an appropriate application with broad claims as well as appropriate application drawings.

We work with professional illustrators to prepare drawings that comply with the Patent Act and Industrial Designs Act.

We work closely with illustrators to capture both the essence and accuracy of a client invention in formal black-ink drawing style.

Once a client approves the draft application, we’ll review filing options including countries and application mechanisms (including the Patent Cooperation Treaty or PCT).

 

The Big Picture

Upon approval, we’ll file that application with the Canadian Intellectual Property Office (CIPO) and report back to our client.

During our initial discussions, we’ll comprehensively review the timelines not just of the above-described, but also the timelines involved whether you file an application in one country or one hundred.

For example, from the time a first application (for a specific invention) is filed, a client may have either twelve months or up to thirty months to decide whether they will file in other countries.

Moreover, we help clients to understand both a short-term and long-term picture, as patents can last as long as twenty years (or more in very limited cases).

We also thoroughly advise clients on what they can expect when they file their same application in different countries, in terms of service experience and local laws.

Just because a patent is granted in one country is no guarantee that the same will be granted in another country, but we help our clients optimize their chances of success.

We take pride in making the application process understandable for our clients.

We work to educate our clients on all aspects of intellectual property so they have context for the protection they seek.

We cover issues such as the application creation process, dealing with CIPO, managing your rights as part of your business, and even maintaining and expanding future rights.
